Terms and Conditions

1. Subject matter

The Tenerife Premium Card (TPCard) is a destination digital platform for Tenerife connecting tourists, residents, partner venues and distribution channels in one ecosystem of commerce, local services and experiences. The digital card is the personal access key to the system, services and network benefits — not a «discount card».

2. Purchase and activation

The card is activated upon payment. Valid from purchase until the end of the contracted period.

3. Card use

The card is personal and non-transferable. Show the QR before ordering. No retrospective discounts are applied.

4. Partner venues

Discounts are subject to availability. The list is updated at tpcard.es.

5. Refund policy

Full refund if the card has not been used. Request within 14 days at info@tpcard.es.

6. Resident Card

Requires proof of residence in Tenerife (NIE or registration certificate).

7. Applicable law

Spanish law. Courts of Santa Cruz de Tenerife.

8. Right of withdrawal (consumers — 14 days)

In accordance with Directive (EU) 2011/83 and Spanish Royal Legislative Decree 1/2007 (arts. 102-105), the consumer has 14 calendar days from the purchase date to withdraw from the contract without justification and without penalty.

Exception for digital content: under art. 103.m of RDL 1/2007, the right of withdrawal does NOT apply once the consumer has consented to the start of the digital service (TPCard activation and QR use) and acknowledged the loss of the right.

How to exercise withdrawal (where applicable):

• Email reclamaciones@tpcard.es (or info@tpcard.es) with subject Withdrawal, stating your purchase email and order number
• Deadline: 14 calendar days from purchase
• Refund: 100% within 14 days of the request, using the same payment method
• Standard form available on request by email

9. Alternative dispute resolution (ADR)

In accordance with Directive 2013/11/EU and Regulation (EU) 2024/3228, the consumer may turn to a certified alternative dispute resolution (ADR) body. Official EU list:

Before turning to an ADR body, you can send a complaint to reclamaciones@tpcard.es — reply within 15 business days.

TPCard does not voluntarily adhere to ADR procedures (art. 13 of Law 7/2017). You may consult the free EU list or the Junta Arbitral de Consumo de Canarias, without prejudice to judicial recourse.

10. Jurisdiction and complaints procedure

Internal procedure: every complaint must first be sent to reclamaciones@tpcard.es. Reply within 15 business days.

Consumer jurisdiction: for residents in Spain, disputes may be resolved in the courts of the consumer's domicile or in Santa Cruz de Tenerife (art. 90.2 RDL 1/2007).

Competent authority: Dirección General de Consumo, Government of the Canary Islands.

12. Digital content guarantee (EU Directive 2019/770)

TPCard guarantees, in accordance with Directive (EU) 2019/770:

• 2-year legal guarantee on the correct functioning of the digital service from activation
• Conformity: the service will be provided as described in these Terms and on the website
• Non-conformity: right to free correction or full refund (invalid QR, inaccessible platform, etc.)
• Proportional suspension of payment during non-conformity

To claim the guarantee: reclamaciones@tpcard.es with a description of the problem and purchase date.

13. Intellectual property and site use

All contents of this site and app (texts, graphics, logos, the TPCARD trademark, partner listings, discount and offer lists, and the underlying database) belong to Tenerife Premium Card or its licensors and are protected by intellectual and industrial property law. The following is prohibited without prior written authorisation:

• Reproducing, copying or reusing the site's contents, in whole or in part, for commercial purposes.
• Accessing the site or extracting its data by automated means (scraping, bots, crawlers or similar techniques), including the extraction of partner listings, prices or offers. The database is further protected by the «sui generis» right (Directive 96/9/EC and its Spanish implementation): extraction and/or re-use of all or a substantial part of its contents is prohibited.
• Using the TPCARD trademark, logo or name, or presenting a site or service as connected to Tenerife Premium Card, without authorisation.
• Framing the site, linking to it in a misleading way, or building services that imitate it in a manner likely to cause confusion.

Search-engine indexing in accordance with robots.txt is permitted. Breaches may lead to suspension of access and to the applicable civil and, where relevant, criminal actions.
